Breath analysis is used in many DUI cases to test blood alcohol concentrations. A breathalyzer is a device used by police to test blood alcohol content. The person is instructed to blow on the device, and it will show whether that person is over the legal BAC limit of 0.08 percent. Many people believe this device is always accurate, however, this isn’t necessarily the case.
Faulty Readings
It has been shown that these devices can be faulty or administered improperly, which can lead to giving a false reading. Breathalyzers do not actually test BAC levels directly; that requires a blood sample. What they do is estimate BAC levels indirectly.
The National Safety Council on Alcohol and Drugs also has recommended that there should be two breath samples collected and analyzed between two and ten minutes apart.
Because of this, it’s important for those pulled over and tested to know that just because these devices show a BAC of above 0.08 percent does not mean that the person is automatically guilty of driving under the influence.
